1. Who we are

EnerCloud is an AI native consultancy providing AI strategy, enablement, build, assurance and security services to enterprises and public institutions. We are an APP entity for the purposes of the Privacy Act.

2. Information we collect

We may collect the following types of personal information:

• Contact information: name, job title, employer, email address, phone number and postal address.
• Engagement information: details you provide when you request a briefing, respond to a proposal, or work with us on a project.
• Recruitment information: where you apply for a role, your CV, work history, qualifications and references.
• Technical information: IP address, device and browser information, and website usage data collected via cookies and analytics.

We do not seek to collect sensitive information unless it is necessary for a specific purpose and you have consented, or the collection is otherwise permitted by law.

3. How we collect it

We collect personal information directly from you where reasonable and practicable for example when you contact us, complete a form, attend an event, or enter into an engagement. We may also collect information from third parties such as your employer, publicly available sources, or recruitment partners.

4. Why we collect it

We collect, hold and use personal information to:

• provide, administer and improve our services;
• respond to enquiries and manage our client relationships;
• assess and manage recruitment applications;
• meet our legal, regulatory and contractual obligations; and
• send you information we consider relevant, where permitted (you may opt out at any time).

5. Disclosure of personal information

We may disclose personal information to our personnel, professional advisers, and trusted service providers (including cloud hosting and IT providers) who assist us in operating our business, subject to appropriate confidentiality and security obligations. We do not sell personal information.

6. Overseas disclosure

Our default position is that personal information is stored onshore in Australia. Where a service provider stores or processes information overseas, we take reasonable steps to ensure the recipient handles it in a manner consistent with the APPs.

7. Data security & retention

We hold personal information using a combination of technical, physical and administrative safeguards aligned with recognised standards including ISO/IEC 27001 and the ACSC Essential Eight. We retain personal information only for as long as necessary for the purposes for which it was collected, or as required by law, and securely destroy or de identify it when no longer required.

8. Access & correction

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. We will respond within a reasonable period. We may charge a reasonable fee for access in limited circumstances, and will explain our reasons if we are unable to provide access or make a correction.

9. Data breaches

We maintain a data breach response plan. Where a data breach is likely to result in serious harm to affected individuals, we will notify those individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches (NDB) scheme.

10. Cookies & analytics

Our website uses cookies and similar technologies to operate the site and understand how it is used. You can control cookies through your browser settings; disabling them may affect site functionality.

11. Complaints

If you believe we have breached the APPs, please contact us using the details below. We will acknowledge your complaint and respond within a reasonable time. If you are not satisfied with our response, you may lodge a complaint with the OAIC at oaic.gov.au.
